While BA has claimed that they can owe no more than the stated $1,500 compensation for the contents of any given bag provided by the Montreal Convention, so far the court doesn't agree. British Airways had such a shocking rate of lost luggage during this period that it looks like they may have fallen under a "reckless disregard" clause that permits higher damages.

Since so many travelers to Greece know the trick of getting an inexpensive flight to London and then taking a regional flight to Greece, this may affect many who went to Greece. To qualify as a member of the class-action suit, you must be an American who flew on any British Airways flight between September 5th, 2005, and September 7th, 2007. And, of course, you must have lost your luggage, had it delayed, or had it damaged. Even if the luggage was eventually returned to you, you may still qualify for damages if the case ultimately succeeds in court.

The attorney filing the case, Steve Berman, works at Hagens-Berman-Sobol-Shapiro LLP. . I spoke with Shane Stevenson, another attorney working on the case, and he told me that the class is not yet certified (closed) and that additional plaintiffs can be added to the class.
